  3. The Accommodation Unit may only be used by Guests specified in the Agreement (or Booking) or by Third Parties approved in advance by the Accommodation Provider. The Customer shall inform the Accommodation Provider in advance of the number of Third Parties and their relationship to such persons. The Customer shall provide the Accommodation Provider with the following data relating to Guests and Third Parties: first name, surname, address, date of birth and identification card number. When completing the Booking form, the Customer is obliged to provide complete and accurate data of the Guest and bears full responsibility for its accuracy and completeness, including obvious clerical or calculation errors. The Accommodation Provider shall not be liable for any consequences arising from incorrect information supplied.

Article V. Termination of the Agreement

  1. The Agreement terminates upon expiry of the period, to which the Accommodation was agreed.

  2. If the Customer fails to pay the full Accommodation Price within the period specified in these GTC, the Accommodation Provider may notify the Customer and grant an additional 5-day period for payment of the whole Accommodation Price. If the Accommodation Price is not paid by the Customer even within this additional period, the Accommodation Provider is entitled to withdraw from the Agreement, whereby the Parties explicitly agreed that in such case the Agreement shall be cancelled from the beginning and the Parties shall return any performance already delivered.

  3. Before the commencement of Accommodation, the Customer may withdraw from the Agreement without giving any reason; however unless in the Agreement, these GTC or on Website of Accommodation Provider stated otherwise, the Customer shall pay the following cancellation fees depending on the number of days before the commencement of Accommodation:

  1. withdrawal up to 2 days before commencement of Accommodation: 100% of the Accommodation Price;

  2. withdrawal from 2 to 7 days before commencement of Accommodation: 50% of the Accommodation Price;

  3. withdrawal more than 7 days before commencement of Accommodation: 0% of the Accommodation Price.

  1. Unless otherwise agreed by the Parties, if the Client and/or Guest fails to arrive at the Accommodation Facility by the scheduled start time of the Accommodation without notifying the Accommodation Provider (so-called no-show), the Accommodation Provider is entitled to a cancellation fee equal to 100% of the Accommodation Price. In such cases, the Accommodation Provider is entitled to make the Accommodation Unit available to other guests on the day following the scheduled start of the Accommodation, without the Client having any claims against the Accommodation Provider.

  2. If Accommodation Price is subject to a discount and designated as “non-refundable,” “non-ref,” and/or “NF,” the Accommodation Provider is entitled, in the event of Customer withdrawal from the Agreement before the commencement of Accommodation and in the event of “no-show,” to a cancellation fee equal to 100% of the Accommodation Price, to which the Customer expressly agrees.

  3. The Client acknowledges and agrees that cancellation fees may differ from those stated above during specific periods of the calendar year or for specific Accommodation Units. If cancellation fees other than those set out in these GTC are listed on the Website (or another platform used for booking Accommodation) for a specific date and a specific Accommodation Unit, such differing cancellation fees shall apply.

  4. The Customer agrees that the Accommodation Provider may set off the cancellation fee against the Accommodation Price already paid, i.e. the Accommodation Provider shall refund only the difference between the paid Accommodation Price and the cancellation fee within 15 days from withdrawal.

  5. The Accommodation Price shall be refunded to the Customer exclusively by bank transfer to the bank account specified to the Accommodation Provider. The Customer shall dully and timely notify the necessary information on his bank account and the Accommodation Provider shall not be liable for incorrectly specified information and any consequences arising therefrom.

  6. After the commencement of Accommodation, the Guest may withdraw from the Agreement before the end of the agreed period of Accommodation; however, the Guest shall compensate the Accommodation Provider for any loss resulting from the premature termination unless such loss could have been prevented by Accommodation Provider.

  7. After Accommodation has commenced, the Accommodation Provider may withdraw from the Agreement before expiry of the agreed period if the Customer, Guest and/or Third Parties using the Accommodation Unit, grossly violate good morals in Accommodation Unit and/or Accommodation Facility or materially breach their obligations under the Agreement, Accommodation Rules or these GTC despite prior warning.

  8. Withdrawal from the Agreement becomes effective upon delivery to the other Party.

  9. The Consumer may also withdraw from the Agreement using the template withdrawal form contained in Annex No. 1 of these GTC, although this is not mandatory. The Withdrawal does not necessarily has to have the form specified in the form, however it has to contain the expression of Consumer´s will to withdraw from the Agreement. In case the Withdrawal does not fulfil this requirement, the Accommodation Provider is entitled to contact Consumer in order to clarify the will of Consumer. If Consumer confirms in writing to the Accommodation Provider its expression of will to withdraw from the Agreement, the Withdrawal is considered as delivered upon this moment of Consumer´s expression of will clarification.

  10. Upon termination of the Agreement or Accommodation, the Guest shall return the keys from the Accommodation Unit to the Accommodation Provider, as well as any other items received from the Accommodation Provider at the commencement of Accommodation. After the termination of Accommodation, the Accommodation Provider shall check the condition of the Accommodation Unit and at the latest within 5 working days, he may eventually request the Customer to compensate damages, if their occurred in the Accommodation Unit and/or Accommodation Facility.

Article VI. Complaints Procedure

The Consumer shall submit the Complaint right after becoming aware of the issue giving rise to the Complaint. Upon submission of the Complaint, the Accommodation Provider shall assess its legitimacy as soon as possible and if the Complaint is found to be justified, the Accommodation Provider shall take remedial action (by ensuring the complained issue to be in compliance with the Agreement), or provide an appropriate discount on the Accommodation.

  2. Complaints (and other grievances or suggestions) after the end of Accommodation may be submitted in writing to the registered office of the Accommodation Provider (i.e. Panenská 18, 811 03 Bratislava) or to the following person: LENSSON, s. r. o., e-mail: izybratislava@gmail.com, telephone number: +421919440945. The Accommodation Provider shall issue confirmation of receipt of the Complaint right after its receipt. Complaint shall be resolved immediately or, in complex cases, no later than 5 business days from receipt of a Complaint, which contains all necessary requirements. The Consumer shall be informed by e-mail on the outcome, i.e. whether the Complaint has been rejected as unfounded or whether the Complaint has been recognised as justified, together with the proposed remedy.

  3. If dissatisfied with the outcome, the Consumer may submit a request for remedy in the same manner as a Complaint, i.e. in writing to the registered office of the Accommodation Provider (i.e. Panenská 18, 811 03 Bratislava) or to the following person: LENSSON, s. r. o., e-mail: izybratislava@gmail.com, telephone number: +421919440945. The foregoing also applies in the event that the Consumer believes the Accommodation Provider has otherwise violated his rights.

  4. If such request of Consumer for remedy is rejected or not answered within 30 days from its delivery and the Agreement was concluded through the Website, the Consumer may apply to an alternative dispute resolution body pursuant to the relevant provisions of Alternative Dispute Resolution Act. In order to protect his rights, the Consumer may, in accordance with this Act, attempt to reach an agreement on resolving the dispute in a lawful manner. The subject of alternative dispute resolution for consumer disputes is the Slovak Trade Inspection or another authorized legal entity registered in the list of alternative dispute resolution entities maintained by the Ministry of Economy of the Slovak Republic (the list of these alternative dispute resolution entities is available at the webpage: https://www.mhsr.sk/obchod/ochrana-spotrebitela/alternativne-riesenie-spotrebitelskych-sporov-1/zoznam-subjektov-alternativneho-riesenia-spotrebitelskych-sporov-1?csrt=740013466649187028 2, or on other actual webpage on www.mhsr.sk).
